MAISE – Artist Terms & Conditions

These Artist Terms & Conditions (“Artist Terms”) apply to all artists, creators, bands, or rights-holders (“Artists”, “you”, or “your”) who create a project page or otherwise use the MAISE platform (“Platform”).
By registering as an Artist or using MAISE, you agree to be legally bound by these Artist Terms and the MAISE Terms of Use.
1. Role of MAISE
MAISE provides a technology platform only.
You acknowledge and agree that:
- MAISE is not your agent, partner, employer, or representative
- MAISE does not manage, supervise, or control your project
- MAISE is not a party to any agreement between you and your fans
You are solely responsible for your project and all related obligations.
1a. Merchant of Record
You acknowledge that you act as the merchant of record for all contributions received from fans through the Platform. MAISE is not the seller of record, and does not bear responsibility for goods, services, or digital content delivered in connection with any fan contributions. You retain full legal responsibility for your relationship with contributors, including chargebacks, refunds, disputes, and compliance with applicable laws covering your campaign activity (including payments).
For clarity, the connected Stripe account you register and link via Stripe Connect will be the account that receives payments from fans, subject only to deductions for disclosed MAISE platform fees. This arrangement reflects your role as the merchant of record, and MAISE’s role as a payments facilitator.
2. Artist Eligibility and Authority
By using MAISE, you confirm that:
- You are at least 18 years old
- You have the legal right and authority to create the project
- You own or control all necessary rights (including music, artwork, branding, and content)
- You have authority to offer any rewards, merchandise, events, or experiences listed
3. Artist Responsibilities
You are solely responsible for:
- Creating accurate, honest, and non-misleading project descriptions
- Producing and delivering all rewards, content, merchandise, or experiences
- Setting clear expectations for fulfilment timelines
- Handling communication with fans
- Complying with all applicable laws, regulations, and tax obligations
MAISE does not guarantee or enforce artist performance.
4. Rewards, Fulfilment, and Fan Relationships
You acknowledge that:
- Fan contributions are made in reliance on your representations, not MAISE’s
- Any obligation to fulfil rewards exists solely between you and your fans
- You bear all costs, risks, and logistics associated with fulfilment
If you fail to deliver a reward, delay fulfilment, or cancel a project, MAISE shall have no liability to fans or to you. Rewards offered through MAISE are intended for personal use only and may not be resold, transferred, or marketed as having monetary value unless expressly authorised by the artist and permitted by applicable law.
5. Prohibited Activities
You must not:
- Offer financial returns, profit participation, royalties, equity, or “investments”
- Misrepresent projects as “risk-free” or “guaranteed”
- Offer unlawful, unsafe, or regulated products- Infringe third-party intellectual property
- Use MAISE for fraudulent or deceptive purposes
- Use language that implies financial upside, returns, appreciation, or future monetary value, including terms such as “investment”, “returns”, “profit”, “earnings”, “ownership”, or similar phrases, even if no such return is formally offered.
MAISE reserves the right to remove content or suspend accounts at its discretion.
6. Payments and Fees
Payments made by fans are processed by third-party payment providers, including Stripe via Stripe Connect. In order to receive payments, you must register for, link, and maintain a valid Stripe account that is compatible with the Platform.
(a) Stripe Connect: You authorise MAISE to facilitate the processing of contributions through Stripe on your behalf under Stripe Connect. This includes MAISE initiating charges, directing transfers to your connected Stripe account, applying platform fees, and, where applicable, issuing refunds in accordance with MAISE policies.
(b) Merchant Responsibilities: You are responsible for handling all refunds, disputes, chargebacks, and related obligations in your capacity as merchant of record, except where MAISE explicitly assumes responsibility under a separate written policy.
(c) You acknowledge and agree that MAISE does not control the payment processors, and that payment providers’ terms and fees apply independently to you and your Stripe account.
You acknowledge that:
- MAISE does not control payment processors
- Payment providers’ terms apply independently
- MAISE is not responsible for chargebacks, refunds, or payment disputes
Any platform fees will be disclosed separately.
6a. Platform Fees.
MAISE may charge a platform fee on contributions processed through Stripe. Platform fees are deducted from the gross contribution amount at the time of processing and remitted to MAISE separate from contributions that are transferred to your connected Stripe account. Platform fees constitute payment for the technology and services provided by MAISE and do not constitute part of the funds you have raised from fans.
7. Taxes
You are solely responsible for:
- Determining and paying all applicable taxes
- VAT, income tax, sales tax, customs duties, and reporting obligations
MAISE does not provide tax advice or tax handling services.
You agree that MAISE, and any payment processor used by MAISE (e.g. Stripe), may share transaction information with tax authorities where required by law.
7a. Payment Processing Authorization and Compliance.
You authorise MAISE to act on your behalf to facilitate payments through Stripe Connect, including initiating charges, managing transfers, and deducting any disclosed platform fees.
You agree to maintain all required accounts and information necessary to enable Stripe Connect processing, and to provide MAISE with any updated or supplemental information Stripe or MAISE may reasonably require.
You acknowledge that MAISE does not hold, retain, or control the funds paid by fans; all contributions are transferred directly to your connected Stripe account, less applicable platform fees. MAISE does not operate an escrow, wallet, or pooled client money account.
You agree to comply with Stripe’s terms, including any requirements for connected accounts, identity verification, and activity limits, and understand that MAISE is not responsible for Stripe’s decisions concerning account access, holds, or restrictions.
7b. Tax and VAT Obligations
You acknowledge and agree that MAISE does not provide tax or VAT treatment advice. You are solely responsible for determining your own tax liabilities, including without limitation, income tax, corporation tax, VAT, and any sales or consumption taxes arising from your use of the Platform or fan contributions.
Under applicable tax law (including in the United Kingdom), certain payments may be treated as consideration for supplies of goods or services and therefore subject to VAT if you are required to register for VAT. If you offer rewards, benefits, merchandise, digital goods, or other items with commercial value, you should assess whether these constitute taxable supplies triggering VAT registration, collection, and remittance obligations.
You agree to comply with all applicable tax laws and accept all liability arising from your tax obligations, including but not limited to ensuring payments to you via MAISE are reported appropriately to tax authorities.
Important: Contributions may have tax consequences for artists. MAISE is not responsible for collecting or remitting VAT or other taxes. Artists are solely responsible for determining whether contributions or rewards are taxable and for complying with applicable laws.
8. Intellectual Property
You retain ownership of your content.
You grant MAISE a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and promote your content solely for operating and marketing the Platform.
You warrant that your content does not infringe third-party rights.
9. Indemnity
You agree to indemnify and hold harmless MAISE from any claims, losses, damages, or expenses arising from:
- Your project or rewards
- Failure to fulfil fan obligations
- Misrepresentations or omissions
- Breach of these Artist Terms
- Intellectual property claims
10. Limitation of Liability
To the maximum extent permitted by law:
MAISE shall not be liable for:
- Fan disputes or claims
- Losses arising from your project
- Indirect or consequential damages
MAISE’s total liability to you shall not exceed the fees paid by you to MAISE in the preceding 12 months.
11. Termination
MAISE may suspend or terminate your account at any time for breach, misuse, or risk to the Platform.
MAISE reserves the right to require modifications to, restrict visibility of, or remove any campaign content that, in MAISE’s sole discretion, may create legal, regulatory, reputational, or compliance risk, including content that could be construed as offering financial returns.
Termination does not relieve you of obligations to fans.
12. Governing Law
These Artist Terms reg governed by the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction over any dispute arising from these Terms or the use of MAISE.

Entire Agreement
These Terms constitute the entire agreement between you and MAISE and supersede all prior or contemporaneous communications, representations, or understandings, whether written or oral.
Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
Waiver
No failure or delay by MAISE in enforcing any right or provision of these Terms shall constitute a waiver of such right or provision.
Assignment
MAISE may assign or transfer these Terms, in whole or in part, withoutrestriction. You may not assign your rights or obligations without prior written consent from MAISE.
